Company Drivers and Independent Contractors DriverHUB Mobile Application Acknowledgement, Disclaimer, and Hold Harmless Agreement DB Schenker’s DriverHUB mobile application (hereinafter referred to as the “DriverHUB mobile application” or the “mobile app”) may be utilized on Android or IOS platforms for a number of functions, which will allow participants to enjoy greater flexibility and efficiency in performing many of their daily tasks, including: ________________________________________________________________________________ • Send and receive both freeform and form messages • Scan and send documents (bills of lading, delivery receipts, and other shipment documents) • View load and stop details, including fuel stops • Plan trips using the interactive Trip Planner Map showing stops, amenities, HOS range • Navigate turn-by-turn using HERE Truck Routing Navigation with live traffic rerouting and floating HOS clock • Accept/Reject planned loads - DB Schenker’s existing forced dispatched policy for Company Drivers shall remain in effect • Perform all Circle-of-Service steps for loads and stops using Dispatch Workflow buttons and forms • Choose your own loads from the Driver Load Board based on your preferences - Independent Contractors • Sync to Geotab for HOS duty status (Driving, On-Duty, Off-Duty, Sleeper-Berth), perform DVIR, view eLogs • Lookup your Elogs history and HOS Clocks • Process the current load and stop from the Home Dashboard Card • Check current Hours of Service from the Home Dashboard Card • Refer to My Info from the Home Dashboard Card • Review recent Paystubs and Current Week Miles • View Safety and Training videos, Permits, and Policies • Report safety issues • Scan Photos for sending DVIR, Collision, Breakdown photos • Show the weather for each stop • Launch other installed apps from the Main Menu such as CAT Scale, FleetAdvance, Drivewyze • Have access to news articles and Company updates • Take a Survey • Visit the Company Store • Contact the Driver Access Line and Departments via Call DB Schenker page • Login using a shared device for Teams, Trainers, and Students • Run the app from tablet devices for larger screen viewing ________________________________________________________________________________ In order to access the DriverHUB mobile application, participants will have to establish and maintain a unique User ID and Password, which must be updated periodically for security purposes. DriverHUB participants shall be solely responsible for maintaining the security and integrity of their respective login and password at all times. The DriverHUB Mobile Application shall not be used or interacted with, or view its contents in any way while the participant is operating a vehicle. Participants shall not tamper with or otherwise attempt to disable, override, or alter this feature in any way and are instructed NOT to use the DriverHUB Mobile Application while they are operating any vehicle – be it a commercial motor vehicle or their personal vehicle. By clicking “Agree” / “Accept” below, the participant specifically acknowledges, represents, and warrants that he/she: 1. Has been given a copy of this DriverHUB Mobile Application Acknowledgement, Disclaimer, and Hold Harmless Agreement and has read the contents of said document, understands and agrees to adhere to, and be bound by, the terms thereof; and 2. Shall establish and maintain a secure User ID and Password and shall protect the integrity, security, and confidentiality of same, updating them as necessary in accordance with standard security protocols of the mobile app. He/She shall not share the User ID and/or Password with anyone else at any time, for any reason. He/She further acknowledges and agrees that DB Schenker shall have no responsibility whatsoever for maintaining his/her User ID and/or Password and he/she further agrees to hold DB Schenker harmless from and against, and releases DB Schenker from, any and all loss, claim, damage, or injury which results from the loss of, or compromising of, the security of, his/her User ID and/or Password; and 3. He/she shall not, at any time, use or interact with the mobile app or view any of the contents thereof while operating a vehicle – whether it be a commercial motor vehicle or personal vehicle. He/She further acknowledges and understands that while operating a commercial motor vehicle, he/she is subject to the rule promulgated by the U.S. Department of Transportation (DoT) Federal Motor Carrier Safety Administration (FMCSA) regarding cell phone usage and agrees to adhere to all applicable laws, ordinances, and regulations. He/She acknowledges and agrees that he/she alone shall be liable for the payment of any fine(s) associated with the issuance of any citation(s) for any violation(s) of the aforementioned FMCSA cell phone rule or any other violation of law, ordinance, or regulation related to cell phone use. He/She further represents and warrants that he/she shall not use or interact with the mobile app or view any contents thereof except when he/she is parked safely in a secure location with the vehicle stationary. 4. The participant acknowledges and agrees that the DriverHUB Mobile Application and its contents are the property of DB Schenker. Participants shall not attempt to reverse engineer the Mobile App or any of its contents, nor share, provide access to, or sell the Mobile App or its contents. By clicking “Agree” / “Accept” below, the participant acknowledges and agrees that he/she has read and understands the contents of this document and agrees to be bound by the terms hereof. This DriverHUB Mobile Application Acknowledgement, Disclaimer, and Hold Harmless Agreement in no way establishes an employment agreement, contract, partnership or joint venture between any participant and DB Schenker and such relationship between the Parties is and remains as-is. The participant further understands, acknowledges, and agrees that he/she alone shall be responsible for the payment of any and all charges on his/her mobile phone bill related to the use of the DriverHUB Mobile Application, without any reimbursement of expenses from DB Schenker. Driver specifically acknowledges that if he/she utilizes the Mobile App (including viewing videos) while not connected to a wi-fi network, such usage may result in additional charges on his/her mobile phone bill, for which he/she alone shall be responsible for the payment thereof.
